The embattled reality star is trying to get the charges dismissed due to what her attorney calls 'defects' in the arresting document.

Wendy Osefo is pushing back against the fraud charges brought against her and her husband, Eddie Osefo, claiming in newly filed court documents that her arrest was unlawful.

The Real Housewives of Potomac cast member was taken into custody on October 9 in Westminster, Maryland, alongside Eddie. Both were charged after a grand jury indicted them on counts including insurance fraud, conspiracy fraud, and making false statements to police.

The couple was released the same day after posting $50,000 bond each.

According to prosecutors, the case stems from an April 2024 burglary report. Investigators allege that while Wendy and Eddie claimed their home had been broken into during a trip to Jamaica, the story did not align with security footage.

Authorities also stated that several items the Osefos reported stolen were later found in their home, raising questions about the accuracy of their insurance claims.

Now, Osefo’s legal team is challenging the way the case has been handled. According to Us Weekly, on October 17, her attorney filed motions seeking to have the charges dismissed entirely, citing “defects in the charging document.” The filing also argues that all evidence gathered should be thrown out because it was allegedly obtained through “an unlawful search or seizure.”

The court documents go further, asking the judge to block “all admissions, statements, or confessions” because they were “unlawfully obtained.”

Osefo’s lawyer also pushed for any wire or verbal communications to be excluded from the case, calling them “an unlawful interception.”

Another key request is for Wendy’s trial to be separated from Eddie’s, a move that could potentially change the way prosecutors present evidence. As of now, Eddie has not listed an attorney on record for his case.

Beyond motions to suppress evidence, Osefo’s attorney also demanded that prosecutors hand over the full scope of their files. That includes the names of all witnesses expected to testify, results of any polygraphs, and information about whether confidential informants were used in the investigation.

Wendy Osefo, who joined RHOP in 2020, has publicly acknowledged the situation only briefly.

Days after her arrest, she posted on Instagram: “And through it all, GOD remains faithful. Thank you for the outpouring of love, support, and prayers for myself and most importantly my family during this time.”

The case remains ongoing in Maryland court.
